Waren Juristen in der DDR "ideologieanfälliger" als die Vertreter anderer Berufe? Dienten die Rechtswissenschaftler einem "Unrechtsstaat"? Wie ging die SED mit den Juraprofessoren um, wie brav befolgten diese die Parteibeschlüsse? Die amerikanische Rechtshistorikerin Inga Markovits benutzt die Juristische Fakultät der Humboldt-Universität zu Berlin als Labor, um zu beschreiben, wie sich Juristen in der DDR im Spannungsfeld zwischen Macht und Recht bewegten. Sie erzählt die 40-jährige Geschichte der Fakultät aus drei verschiedenen Perspektiven: als Anpassung und Unterwerfung unter die SED, als mürrisches Ausweichen und Unterwandern von Parteibeschlüssen sowie als Verschleiß des politischen Glaubens an den Sozialismus oder zumindest an die Partei. Markovits resümiert: Die DDR wurde nie zum "Rechtsstaat" im technischen Sinn des Wortes, aber sie war auch kein "Unrechtsstaat", sondern bewegte sich im Laufe der Jahrzehnte vom "Nicht-Rechtsstaat" allmählich auf den Rechtsstaat zu. |
